Judicial Reform QA הרפורמה בשיפוט

Updated: 5 days ago

"One MK tweeted to arrest Lapid/Golan turning a legal discussion into fear of a dictatorship/halachic state. Good luck discussing merits now."

Judicial reform. Good question. So I for the most part have been avoiding getting into judicial reform. And you're right, I have a legal background in the United States and I studied law in the UK. And the reason why is because this topic is one that was switched over from a discussion of actual judicial reform, which anyone who has studied law knows that the israeli system here that they've created is a fraud, is absurd.

But the problem is once you start to discuss that, the population here is so divided that if you're against it or for it, you're all of a sudden in one camp or another. And the reason for that is because this issue, which really is just an issue of of legal authority, but it has become an issue that has shifted, as we said earlier in this talk -- we said it shifted from the mind to the heart.

And why has it gone to the to the heart? Why would a topic that's really just about reasonableness and how you select judges and and judicial review and these terms that really people don't care so much about? How does that go to the heart?

Because it was shifted by some comments by right-wing MKs who made this more than it had to be. They turned it from, like I said, a legal discussion into a fear that we're going to have a halachic state, a fear that we're going to have a dictatorship.

One right-wing MK, we won't -- it doesn't matter who. He tweeted that they should arrest Lapid and they should arrest Golan. They wanted to arrest the opposition and they wanted to arrest the former prime minister, which kind of sends us into South American country territory, where every former leader goes to jail.

So once that was switched into that realm, to go and try to discuss on the merits, to discuss the the details of judicial reform and judicial selection and and going from a parliamentary system to a constitutional system based on some nonsensical ideas and basic laws and blah blah blah.

Nobody's interested in that. They just think that you want to take over the government and turn into a halachic state and good luck now discussing those topics.
